Employment Law Presentation, New Department of Labor Regulations That Govern All of Us
Mike Foley from Foley & Foley, PC will explain all the hype surrounding the long-awaited and much-debated
White Collar regulations that take affect 12/1/16.
This is complicated stuff because the risk is not limited to the Fair Labor Standards Act. Massachusetts has its own unique wage and hour regulations. Massachusetts recognizes some but not all of the exemptions and tests recognized by the FLSA. The stakes are high.
The DOL has already set up field offices in every state and is conducting random audits. The fines associated with these audits would hurt. In addition to unpaid overtime, misclassification
of employees can result in liquidated damages, equitable relief and reimbursement of attorneys fees.
